On January 31, 2017, Sarah Yantakosol Gayer presented on the panel "Current State of Affairs with Punitive Damages and What Actions Will Support Claims for Punitive Damages?" at the American Conference Institute's 6th Annual Forum on Admiralty & Maritime Claims and Litigation in Miami, Florida. This presentation explored punitive damages with respect to seamens' claims and non-seamens' claims, the propriety of refusal to allow a Jones Act plaintiff to amend a complaint to assert a claim for punitive damages under the Jones Act and general maritime law unseaworthiness, the Supreme Court's one-to-one ratio of punitive to compensatory damages in admiralty cases, and the development of courts' recognition of availability of punitive damages in maintenance and cure claims.
